In June of 2019, Denyse Clancy and Joseph D. Satterley of Kazan McClain Satterley & Greenwood secured a $12 million verdict against Johnson & Johnson and Colgate-Palmolive for Patricia Schmitz, who alleged that the companies’ cosmetic talc products contained asbestos and caused her mesothelioma, a type of cancer that currently has no cure.
Schmitz, who was a 61-year-old retired teacher, testified at trial that she used talc powder products throughout her life, including Avon’s Night Magic, Colgate’s Cashmere Bouquet, and J&J’s Baby Powder.
After a week of deliberations, the California state court jury awarded Schmitz $12 million in compensatory damages. The jury assigned each company 40 percent responsibility for Schmitz’s illness and assigned the remaining 20 percent to Avon Products Inc., which was not a defendant in the case. Sadly, Ms. Schmitz died shortly thereafter, on July 14, 2019, but at least had the satisfaction of knowing she got justice.
